Personal Injury Lawyers Cantor and Burger Protect $175,000 Premises Liability Judgment

St. Louis personal injury lawyers Cantor and Burger took on a large insurance company this week when the insurance company tried to overturn a $175,000 judgment for one of our clients.  Our client was badly injured on Defendant’s property because Defendant was negligent in maintaining it.   Filing a Motion to Intervene and a Motion to Set aside, the insurance company argued it lacked notice of the lawsuit and therefore should not be subject to the judgment.  Put another way, it wanted to avoid paying our client.  Their motions presented several interesting procedural issues:

  1. Whether an insurance company can intervene in a personal injury judgment?
  2. Whether the insurance company’s intervention to the personal injury judgment is untimely after one year?
  3. Whether the insurance company’s motion to set aside a personal injury judgment is untimely after one year?

Unfortunately for the insurance company, Cantor and Burger was the personal injury firm on the other side and the law was in our client’s favor.  Cantor and Burger vehemently argued the motion in Warren County and the judge ruled in our favor–that our client’s judgment cannot be set aside and the insurance company cannot intervene because it was too late.  The insurance company’s motions were both denied due to the hard work and diligence of Cantor and Burger.

To obtain medical records for our clients, Cantor and Burger uses a Health Authorization form that complies with the Health Insurance Portability and Accountability Act.  The form requests the complete medical record for our client from each medical provider.  Sounds simple right?  It’s not.  Most medical providers only provide the medical records they have personally created.  They do not provide their complete medical file for our clients, which includes the medical records they received from other providers.

It’s often important to have the entire medical record to know what each doctor knew when he or she saw our client.  Having only the records that doctor produces is only part of the complete picture.  Without the entire file, we can only speculate the reasons for treatment or what knowledge the doctor had when making care decisions for our clients.
