What if I’m injured at work?
Then you are covered by Workers’ Compensation Laws, which are your exclusive remedy against your employer. As a general matter, your employer must pay for all of your medical care from an on-the-job injury and pay you 2/3 of your weekly wages if you miss work because of the injury. You should file a report of personal injury with your employer and pursue all necessary medical care. You should also come in and meet with Cantor & Burger attorneys to discuss your rights. Your employer is obligated to compensate you for any resulting disability you have from your workplace injury, and Cantor & Burger currently represents hundreds of people in these types of claims.
What should I do if I am injured in a motor vehicle accident?
Identify any people who saw the accident so that you will have witnesses to support your case. Make sure to write down their names, addresses, and phone numbers. Talk to police officers and advise them of what happened in the accident. Obtain the name, address, phone number and insurance information of the driver who is at fault (unless its you). If you are injured in the accident, go to the emergency room or go see your medical doctor. Do not let the insurance company choose a doctor for you. You have a right to choose your own physician.
Who will pay for the doctor bills and fix my car if the other person has no insurance?
Even if the driver does not have any insurance, you may be covered. Please call our office. We will look at your policy and tell you if you have uninsured motorist coverage or an alternate type of insurance that may compensate you.
How much is my case worth?
The short answer is that we do not know. If you successfully make a claim, you are typically entitled to recover past and future medical expenses, wage loss, other economic damages, and damages for pain and suffering, disability and disfigurement. We will examine all of the circumstances of your case, obtain evidence to prove all your damages, and conduct a full medical analysis to identify your damages and to arrive at a figure which we believe the liabile party, or its insurance company, must pay for your injuries.
How long will it take to get a fair and reasonable settlement offer?
Cases can vary in length from weeks to months, even to years in some instances. Typically, we will only try to settle your case after you have fully healed from your injuries and have been released by the doctor. This is the best way you can be assured of receiving full value for your injuries. In the interim, we investigate and aggresively pursue your case on other fronts so we will be ready to settle your claim or file suit. It is our practice to move fast on cases and resolve them as rapidly as possible. However, we will not discount the value of your claim to settle early, and we do not hesitate to file lawsuits and proceed through litigation to maximize your claim.
Will I have to go to Court?
If the insurance company agrees to pay what we agree your case is worth, and you wish to settle for that amount, then your case will not go to court. However, Cantor & Burger specializes in trying lawsuits and obtaining results. Ultimately, it is only the threat of going to court (with great lawyers to advocate for you) that causes real settlement offers from the other side. If a recalcitrant defendant/insurance company refuses to recognize the real value of your claim, we will file suit and proceed to trial. Many times the defendant/insurance company will see the error of its ways and satisfactorily settle a case. If they do not, we go to trial and obtain a verdict. We prepare all of our cases as if they were going to court and negotiate cases on that basis.
How much will Cantor & Burger charge?
There is no fee unless we recover money for you. Our fee is a percentage of your recovery — which is often called a contingency fee. If a recovery is not made, you pay nothing for attorney fees. If we recover for you, you pay us a percentage of the recovery pursuant to a contract we enter into at the beginning of the case.
Who will pay for the costs of the lawsuit?
Cantor & Burger will normally advance the costs of prosecuting the case, including investigation, expert witness fees, depositions, court fees, travel, photography, exhibit preparation, accident reconstruction and other costs associated with the case. If we recover money for you, the costs associated with the case are deducted from the recovery.
Can’t any lawyer handle any type of case?
Technically yes. But it is important for you to ensure that you hire lawyers with the training, expertise, trial experience and proven results to maximize your recovery. Cantor & Burger has these qualities and more. With our firm, you also get aggressive representation and lawyers committed to fighting for your rights.
