Many people believe that if they have an on the job injury in their own private car that they have only a civil action. A civil action is when you sue another person for negligence – such as causing a ca accident. But if you are working at the time of the injury, you also have a Missouri Workers’ Compensation claim. There is nothing in the law that prohibits you from filing both a workers’ compensation claim and a civil lawsuit. With proper representation, if you are injured during the course and scope of your employment you have more than one claim, both a civil and workers’ compensation claim, and you should pursue both.
This firm has handled many cases that are both workers’ compensation as well as civil cases. In the case of Anthony Walsh, Mr. Walsh was killed in a terrible truck accident while working. Gary Burger successfully handled the civil portion of that case for this law firm and recovered the spouse and child a huge amount of money. Mark Cantor then handled the workers’ compensation matter and successfully pursued a claim against the employer/insurer. (By the way, in death cases at work – the employer is only responsible to pay the funeral expense if there are no financial dependents. In other words, the spouse in not financially dependent and has a job and does not rely upon the husband for money technically workers’ compensation would only owe for the funeral expense. Is that unfair? This law firm thinks so.) Once the workers’ compensation matter was resolved we had to deal with the issue of subrogation wherein the portion of the money was repaid back to the workers compensation carrier, but the entire package was resolved and we were able to successfully collect from a few different insurers for this terribly damaged family as a result of a work related catastrophic injury.
